Leesburg man sentenced on attempted felonious assault charge
A Leesburg man has been sentenced to a year and a half in prison after pleading guilty to attempted felonious assault.
Kevin D. Treadway, 50, of Leesburg was originally charged with felonious assault, a second-degree felony, in December. The indictment accused him of “knowingly causing serious physical harm” to a victim on or about Oct. 13.
According to court records, Treadway pleaded guilty to an amended count of attempted felonious assault, a third-degree felony, on March 12.
Under the plea agreement, it was stipulated that the state would “take no position” as to sentencing for the charge, which carried a potential prison term of nine to 36 months, according to court records. The victim asked for the maximum term to be imposed, while Treadway’s attorney, Kathryn Hapner, said that she was “not sure that anything is to be gained by sentencing him to prison.”
Hapner asked for the court to consider imposing community control, arguing that Treadway had medical issues and no felony criminal record, while she also pointed out there is “no reason” for Treadway and the victim to have any future contact.
After hearing those comments, Highland County Common Pleas Court Judge Rocky Coss sentenced Treadway to 18 months in prison, with jail time credit of one day, during a hearing May 1.
