Sentencing reversed for woman who pleaded guilty to burning fingers of child

The Twelfth District Court of Appeals has reversed the sentence of a Wilmington woman who had pleaded guilty to felonious assault after she burned the fingers of a child as a form of punishment.

According to a release from the court of appeals published online Monday, the matter was sent back to the Clinton County Court of Common Pleas for resentencing.

Teresa Moore pleaded guilty to felonious assault when, as a form of punishment, she burned the fingertips of a child she was babysitting.

Moore appealed to the Twelfth District and argued that her guilty plea, conviction, and sentence should be reversed because the trial court improperly advised her of the length of her parole following her release from prison.

Writing for a unanimous court, Judge H.J. Bressler found that the trial court improperly advised Moore that she would be subject to parole for five years when the court should have advised her that the term would be three years for committing a second-degree felony.

However, Judge Bressler found that the proper remedy is to send the case back to the trial court for a new sentencing hearing. Presiding Judge William W. Young and Judge Stephen W. Powell concurred in the opinion.

The decision of the Twelfth District Court of Appeals reversed Moore's sentence and sent the case back to the trial court for further proceedings.
