Jacobs appears for pretrial hearing on attempted murder charge

The trial for a Hillsboro man charged with shooting another man in the face will proceed on May 23, according to Highland County Common Pleas Court. 
Jimmie Jacobs, 64, appeared before Judge Rocky Coss Monday afternoon for a final pretrial, with his attorney Jim Boulger. Jacobs used a walker to walk to the defense table, and utilized an oxygen tank.
The state was represented by Assistant Highland County Prosecutor David Henry. 
Jacobs, is charged with shooting 28-year-old Jonathan Harris in the face, according to the Hillsboro Police Department, on the evening of Dec. 15 at J and J Automotive, located at 60 Belfast Pike. 
 
Jacobs was initially taken into custody and charged with felonious assault. Following the incident, Harris was listed in critical condition at Miami Valley Hospital in Dayton. In March, Jacobs was indicted on one count of attempted murder with a gun specification, a felony of the first degree; one count of felonious assault with a gun specification, a felony of the second degree; and one count of aggravated burglary with a gun specification, a felony of the first degree. 
 
The victim and several family members were in attendance for the hearing. 
Boulger said that he had received the state's discovery, but had not had time to review all the components. Coss asked if Boulger anticipated any pretrial motions, and Boulger said there was potentially one issue.
"There is possibly one pretrial motion, regarding some statements that were made (when Jacobs) was in custody," Boulger said. 
Coss said the last day for defense discovery would be May 6, and he scheduled another pretrial for May 4 at 1 p.m.
Coss stated that Jacobs had some health issues recently, and asked if there were any hospital appointments that were scheduled. Boulger said there were not any scheduled.
