Greenfield man to proceed to trial after withdrawing plea on charge of unlawful sexual misconduct with a minor
A Greenfield man will proceed to trial after withdrawing his plea on a charge of unlawful sexual conduct with a minor, a felony of the third degree.
Gilbert Stonerock, 35, pleaded guilty to the charge on Jan. 7, and was scheduled to be sentenced on Feb. 17, according to court documents from the Highland County Common Pleas Court.
Stonerock's attorney Lee Koogler said that his client withdrew the plea when they were unable to reach an agreement on sentencing.
"We had entered a plea in the case, and believed we had a favorable recommendation, with the state recommending community control," Koogler said. "The parties were advised by the court that it would not go along with the recommendation for community control."
Koogler said that with Stonerock now facing prison time, he withdrew the plea.
A trial has been scheduled for March 24.
"The court pretty much said on the record there would be no plea offer and we would be going to trial," he said.
