Greenfield man charged with rape among Highland County grand jury's September indictments

A Greenfield man accused of raping a child under the age of 10 was among the 11 individuals indicted by a Highland County grand jury during its Tuesday, Sept. 9 session.

Paul S. Cox Jr., 33, of Greenfield was charged with rape, a first-degree felony; and gross sexual imposition, a third-degree felony. 

The indictment alleges that during an approximate two-day period, Cox “did engage in sexual conduct with” a victim “less than 10 years of age.” During that same time period, Cox is accused of “having sexual contact with” the victim or “causing [the victim] to have sexual contact” with Cox or another individual.

In other indictments:

• Samantha Snively, 29, of Washington Court House was charged with trafficking in a fentanyl-related compound, a second-degree felony; possession of a fentanyl-related compound, a second-degree felony; and illegal conveyance of weapons or prohibited items onto the grounds of a detention facility or institution, a third-degree felony.

On or about July 28, Snively is accused of “knowingly obtaining, possessing or using,” and “knowingly preparing for shipment, shipping, transporting, delivering, preparing for distribution or distributing,” a fentanyl-related compound in an amount that equals or exceeds 100 unit doses but is less than 200 unit doses or equals or exceeds 10 grams but is less than 20 grams. It is alleged Snively “knew or had reasonable cause to believe that the controlled substance was intended for sale or resale by [Snively] or another person.”

On the same date, Snively is accused of “knowingly conveying, or attempting to convey … a drug of abuse” into the Greenfield jail.  

• Cody R. Frederick, 36, of Greenfield was charged with one count each of tampering with evidence and having weapons while under disability, both third-degree felonies; and a forfeiture specification. 

Frederick is accused of “altering or destroying, concealing or removing a record or document or thing with the purpose to impair its value or availability as evidence” while allegedly “knowing that an official proceeding or investigation was in progress or was about to be or likely to be instituted” on or about Aug. 5. For that same date, Frederick is accused of “knowingly acquiring, having, carrying or using a firearm” while “not having been relieved from disability” for a prior domestic violence case in Fayette County. The 16-gauge shotgun allegedly in Frederick’s possession is subject to forfeiture.

• Eric Taber, 43, of Greenfield was charged with one count each of tampering with evidence, a third-degree felony, and aggravated possession of methamphetamine, a fifth-degree felony. 

It is alleged that on or about Aug. 14, Taber “did alter or destroy, conceal or remove a record or document or thing with the purpose to impair its value or availability as evidence” while allegedly “knowing that an official proceeding or investigation was in progress or was about to be or likely to be instituted.” On the same date, Taber is accused of “knowingly obtaining, possessing or using” meth.

• Joseph C. Rackley, 45, of Bainbridge was charged with aggravated possession of methamphetamine, a third-degree felony. It is alleged that on or about April 26, Rackley “knowingly obtained, possessed or used” meth “in an amount that equals or exceeds bulk amount but less than five times bulk amount.”

• Andrea O’Connor, 42, of Greenfield was charged with grand theft, a fourth-degree felony. Over the court of several months, O’Connor is accused of “knowingly obtaining or exerting control over … U.S. currency” valued between $7,500 and $150,000 without the owner’s consent.

• Brandy Kimmey, 50, was charged with one count each of forgery and illegal use of food stamps or WIC program benefits, both fifth-degree felonies. Both charges stem from an alleged incident on or about July 15.

• Andrew Rackley, 36, of Bainbridge was charged with one count each of aggravated possession of methamphetamine and obstructing official business,  both fifth-degree felonies. Both offenses are alleged to have occurred on or about March 7.

• Phillip S. Heslar, 51, of Blanchester was charged with aggravated possession of methamphetamine, a fifth-degree felony.

• Rachel E. Kenser, 37, of Batavia was charged with aggravated possession of methamphetamine, a fifth-degree felony.

• Christopher VanAllen, 46, of Hillsboro was charged with aggravated possession of methamphetamine, a fifth-degree felony.

An indictment is merely a charge and is not evidence of guilt.
