Wenstrup applauds federal court decision in House’s Obamacare lawsuit

On Friday, Congressman Brad Wenstrup (OH-2) applauded the recent decision in House v. Burwell, a lawsuit brought by the U.S. House of Representatives against the Obama Administration over certain spending provisions within the Affordable Care Act (ACA).

On July 30, 2014, the House voted to sue the Obama Administration for spending millions of taxpayer dollars under the ACA’s cost-sharing reduction program without the necessary appropriation from Congress. After nearly two years of legal procedure, on May 12, 2016, Judge Rosemary Collyer of the D.C. District Court ruled in favor of the House, stating that the Administration’s actions violated Article I Section 8 of the Constitution giving Congress the power of the purse.
“This is a huge win for the Constitution,” Wenstrup said. “Time and again, this president has ignored the law of the land and overstepped his authority, infringing on Congress’ Article I powers and ignoring ‘We the People.’ I’m glad to see the federal court defend the Constitution’s separation of powers and hold the president accountable.”
