Ohio Secretary of State Jon Husted has filed an appeal in Case Number 2:06-cv-00896, Northeast Ohio Coalition for the Homeless et al v. Husted, which received an initial ruling from Federal Judge Algenon Marbley.
The ruling directly conflicts with a judgement issued on May 24, 2016 by Federal Judge Michael Watson, of the same federal district court, as both cases include the issues of absentee and provisional ballots. The Ohio Democratic Party was a plaintiff in both cases.
“Unfortunately, in the time span of just two weeks, the integrity of our elections has been jeopardized as two federal judges have issued decisions that directly conflict with each other and put our elections process in limbo with no clear path forward absent a clear ruling from the appellate court," Husted said.
“Partisan plaintiffs who have challenged these democratically passed laws are attempting to claim victory, but the only thing that has been achieved is chaos and voter confusion.
“The federal courts have created this problem and it is up to them to fix it, which is why I must appeal this decision.”
