A Montgomery County grand jury Thursday handed down a four-count indictment charging a Hillsboro man with aggravated vehicular homicide as well as two misdemeanors, as reported by the Dayton Daily News.

According to the Dayton Daily News as well as Montgomery County Common Pleas Court records, Jonathan M. Elkins, 45, was charged with two counts of aggravated vehicular homicide, one second-degree and one third-degree felony; one count of operating a vehicle under the influence of drugs, alcohol or a combination of both, a first-degree misdemeanor; and one count of OVI (operating a vehicle under the influence), a first-degree misdemeanor.

The indictment alleges that on or about Feb. 2, Elkins “did, while operating or participating in the operation of a motor vehicle … cause the death” of another person. It is alleged that the offense occurred “as a proximate result of committing an offense in Section 4511.19 (A)” of the Ohio Revised Code, which deals with driving under the influence of alcohol or drugs.

It is alleged in the other vehicular homicide count that Elkins “did … recklessly cause the death” of the same victim.

An arraignment is scheduled for July 25.

An indictment is merely a charge and is not evidence of guilt.
