Area man pleads guilty to sexual conduct with a minor

A Dodson Township man pleaded guilty Friday in Highland County Common Pleas Court to a bill of information on a charge of sexual conduct with a minor.
Nicholas A. Smith, 31, was indicted May 4 by a grand jury in Highland County Common Pleas Court on one count of sexual battery, a felony of the third degree.
According to the Highland County Sheriff's Office, the charge was the result of an investigation by the sheriff's office and caseworkers from Highland County Children Services into allegations that Smith allegedly engaged in sexual activity with the 14-year-old female. Smith was arrested on May 6.
On Friday, the Highland County Prosecutor's Office filed a bill of information, which according to Prosecutor Jim Grandey, "We changed the actual charge he was pleading to, and according to the judge we can't make a motion to amend. We made a new charge, waiving that the previous charge had been presented to the grand jury, and basically the bill of information acts like an indictment.'
The bill of information states, "On or about March 1, 2010, and in Highland County Ohio, Nicholas A. Smith, being 18 yeas of age or older, to-wit, 31 years of age, did engage in sexual conduct with ... a minor not the spouse of said Nicholas A. Smith."
Grandey said Smith pleaded guilty to the bill of information, a felony of the third degree. Smith was represented by attorney John Ryan, of Datyon.
A sentencing hearing has been scheduled for Sept. 8 at 9 a.m.
