Appeals court upholds Brown County vehicular homicide conviction

The Twelfth District Court of Appeals upheld the conviction of a truck driver who caused the death of one person and seriously injured two others when his truck crashed into the rear of a sport utility vehicle on state Route 32 in 2007.

According to a report from the court, Kenneth Taylor was charged after he drove his commercial truck into the rear of the SUV stopped at a traffic signal at St. Rt. 32 and the Eastwood Road cross street on Dec. 21, 2007. Taylor was convicted by the Brown County Common Pleas Court of one felony count of aggravated vehicular homicide and two felony counts of vehicular assault. He appealed.

Writing for a unanimous court, Judge Stephen W. Powell held that the conviction should be upheld because there was sufficient evidence at trial to find that Taylor recklessly caused the death and injuries while driving the truck. Presiding Judge William W. Young and Judge Robert A. Hendrickson concurred in the opinion.

The decision of the Twelfth District Court of Appeals denied Taylor's attempt to overturn his conviction.
