EPA reaches settlement with CCU Coal and Construction for alleged Clean Water Act violations in Bellaire

U.S. Environmental Protection Agency recently announced a settlement with CCU Coal and Construction LLC, located at 5100 Guernsey St. in Bellaire, Ohio, to resolve alleged stormwater discharge violations of the Clean Water Act. Under the terms of the settlement, the company will pay $60,541 in penalties.   

The company allegedly did not conduct required copper and chloride monitoring in industrial stormwater that was discharged from the company’s facility into the Ohio River. On at least one occasion, the company allegedly discharged copper in amounts that exceeded permit limits. The company also allegedly did not have stormwater control measures in place.

In May, EPA issued an order requiring CCU Coal and Construction to take certain actions to come into compliance no later than early November. These actions include, but are not limited to, developing an adequate stormwater pollution prevention plan, implementing stormwater control measures at the site, and completing all sampling requirements of discharges of stormwater associated with industrial activities.
