A Hillsboro man has pleaded guilty to two felony charges related to child pornography in Highland County Common Pleas Court.
Dana Jeter, 52, of Hillsboro, entered guilty pleas on counts one and two of a 17-count indictment Wednesday. As part of the plea agreement, the remaining 15 counts were dismissed.
Jeter, a physical therapist, was indicted in January on 17 counts of illegal use of a minor in nudity-oriented material or performance, all felonies of the second degree.
The state, represented by Highland County Prosecutor Anneka Collins, recommended that Jeter be sentenced to a total of five years in prison. He also could face up to a $20,000 fine. He could face a maximum of eight years in prison on each charge.
On July 22, Highland County Common Pleas Court Judge Rocky Coss ruled against a motion to suppress filed by Jeter's attorneys. The motion argued that Jeter's Constitutional rights were violated when law enforcement utilized software on Dec. 27, 2010 to view files on his computer, and that a search warrant executed on Jan. 18, 2011, lacked probable cause because it "relied upon the results compiled by the software."
Collins told the court July 22 that files that were observed with the software by law enforcement in December were in a "shared" folder on Jeter's computer and were available for access through a file-sharing network that Jeter was a member of.
Jeter had been scheduled to stand trial Aug. 22. He appeared in court Wednesday with his attorney, Justin Gray. His other attorney, Ronald Frey, was not present.
On Wednesday Coss accepted Jeter's guilty plea and ordered a pre-sentence investigation. A sentencing hearing has been scheduled for Aug. 17 at 1 p.m.
