Appeals court upholds rape conviction

The Twelfth District Court of Appeals has affirmed the conviction of a Brown County man for rape, according to a court decision posted Monday.

On July 8, 2009, according to the court, Dewayne A. Chambers was convicted of one count of rape. The trial court notified Chambers that upon his release from prison, he would be subject to community notification for the rest of his life.

On appeal, Chambers argued that the trial court was required to hold a hearing in order to decide whether he should be subject to the community notification requirements. Writing an opinion for a unanimous court, Judge H.J. Bressler found that the trial court did not err after it did not hold a hearing, because Chambers never requested one. 

Presiding Judge William W. Young and Judge Stephen W. Powell concurred in Judge Bressler's opinion.

Jessica Little, Brown County Prosecuting Attorney, Mary McMullen, represented the state in the proceeding and Brown County public defender Katherine M. Kelly represented Chambers.
