Washington Court House man sentenced to prison for having weapons under disability
A Washington Court House man has been sentenced to a year and a half in prison after pleading guilty to having weapons under disability in Highland County.
Dustin J. Schwalbauch, aka Dustin J. Schwalbaugh, 33, was indicted in June on one count of having weapons under disability, a third-degree felony, and a forfeiture specification.
The indictment alleged that on or about May 9, Schwalbauch “did knowingly acquire, have, carry or use” a 12-gauge shotgun, which is subject to forfeiture.
According to a bill of particulars, Greenfield Police officers responded after receiving a report that Schwalbauch was “high on drugs” and “pacing back and forth carrying a shotgun” at an area residence. A loaded shotgun was found in the kitchen.
Schwalbauch was not relieved from disability, having been convicted of aggravated assault in Highland County Common Pleas Court in 2015, the bill of particulars says.
Schwalbauch pleaded guilty to the felony charge and forfeiture specification July 6, according to court records. Highland County Common Pleas Court Judge Rocky Coss sentenced him to a definite determinate term of 18 months in prison, with jail time credit of 58 days.
