Man charged with attempted assault on law enforcement with firearm bound over to grand jury

A South Salem man facing three second-degree felony charges of attempted assault of a police officer with a firearm has been bound over to Highland County Common Pleas Court for presentation to a grand jury.
Justin Stubbs, 32, was arrested Aug. 28 after he allegedly fled from a vehicle, in which he was a passenger, during a traffic stop on Willow Street in Hillsboro. In addition to the three attempted assault charges, Stubbs is facing charges of having weapons under disability, a felony of the third degree; carrying a concealed weapon, a fourth-degree felony; and misdemeanor charges of theft, obstructing official business, aggravated menacing and resisting arrest, according to Hillsboro Municipal Court.
During a hearing held Thursday, accompanied by his attorney David Pence, Stubbs pleaded no contest to the aggravated menacing charge. As a result of the pleas, presiding Judge David McKenna said from the bench, the remaining misdemeanor charges were dismissed. McKenna sentenced Stubbs to a suspended 180 days in jail on the menacing charge.
McKenna ruled that the court found there was enough evidence on the felony charges to bind them over to common pleas court for consideration before a grand jury.
According to a news release from the Hillsboro Police Department, the Ohio State Highway Patrol made the traffic stop around 3:30 a.m. Aug. 28 and called for assistance from the Hillsboro Police Department. According to the release, the driver of the vehicle said Stubbs was "on the run from the law" and was armed with a handgun. It was believed Stubbs had fled to a residence on Willow Street.
As officers approached the Willow Street residence, two people were noticed near a vehicle in the driveway. When approached, Stubbs fled on foot, according to the HPD. Officers used tasers on Stubbs, to no avail. As officers continued to attempt to apprehend the suspect, Stubbs "reached for his waistband and attempted to remove a 9 mm handgun," the HPD said. After a struggle, officers were able to subdue Stubbs.
McKenna said Stubbs could face up to 8 years each on the attempted assault charges, which involved one officer with the HPD and two officers with the Highland County Sheriff's Office. He could face 1-5 years on the weapons charge.
McKenna noted that during the time of the alleged incident on Aug. 30, Stubbs had been placed under curfew and was not permitted to be out at that time.
During his arraignment hearing held Aug. 30, when asked by McKenna if he had received a copy of all his charges, Stubbs said, "Yeah. And it's all (expletive omitted)."
