Lynchburg council approves sewer rates

The Lynchburg Village Council has passed an ordinance to establish sewer rates and declare an emergency.
According to a news release from Lynchburg Mayor Jeremy Shaffer, he presented Ordinance 2010-16 and supportive information at the Oct. 14 council meeting. The council passed the ordinance unanimously, waiving the three-reading rule. 
"The sewer base rate will be reduced by a combined 10 percent over the next three years," Shaffer said. "Starting after the first meter reading in January of 2011, the base sewer rate will be reduced by 4 percent, and then a subsequent 2 percent each proceeding year through 2014.
"Over the last three years, Lynchburg has reduced spending and balanced its budget," Shaffer said. "Due to reductions in expenditures, sewerage funds have been
growing at a rate greater than the monies needed for operations and long-term debt."

AN ORDINANCE TO ESTABLISH SEWER RATES AND TO DECLARE AN
EMERGENCY
WHEREAS, the Village has adopted Ordinance No. 2007-3 setting sewer rates in the Village, and the Council desires to have separate legislation for each of the Village Utilities, Now, Therefore BE IT ORDAINED by the Council of the Village of Lynchburg, State of Ohio, that
SECTION ONE:
The rates to be charged for sewer furnished by the Village sewer department to all consumers of Village is hereby fixed at the minimum base rate and surcharge as follows: Base Rate of $45.00 for 0 to 2000 gallons, and a surcharge of $.20 for each additional 100 gallons over the Base Rate.
SECTION TWO:
Beginning after the first water reading of January 1, 2011, the base sewer rate shall decrease by the following percentage rate: Four Percent (4%) in 2011, Two Percent (2%) in 2012, Two Percent in 2013, and Two Percent (2%) in 2014.
SECTION THREE:
The sewer tap fee shall be $2500 per dwelling unit. Payment of this fee obliges the Village to provide the piping riser required to attach to the sewer main. Any
digging/excavation to the sewer main for the purposes of installing line and riser shall be the responsibility of the property owner.
SECTION FOUR:
All monthly utilities charges for water, sewer, trash, storm sewer, and any other Village billed utility will be billed to each address or dwelling units. Multi-family dwellings will be billed no less than the minimum allowable rates per address or dwelling unit even in the event the owner/manager may be receiving only one billing statement.
SECTION FIVE:
The rates and charges provided herein may be adjusted by application to and approval by Village Council to promote economic development or to equitably apportion additional stress imposed on the system.
SECTION SIX:
No business or property with an inactive sewer tap will be charged a monthly sewer bill until said sewer tap is reactivated.
SECTION SEVEN:
This legislation is hereby declared to be an emergency measure necessary for the preservation of the public health, safety and welfare of the citizens of Lynchburg and for the reason that immediate action is needed to provide adequate funding for the operation of the Village sewerage and works, therefore, this legislation shall become effective upon passage by a 2/3rds majority of the members of council.
