Psychiatrists, impeachment and justice

After a period of silence, Dr. Bandy Lee and her committee of mental-health “experts” have again burst onto the scene, angling to participate in the impeachment of President Donald Trump. They are defying the Goldwater Rule, which holds that it is unethical for physicians to diagnose patients they have not personally examined.
They claim that President Trump is a such a serious threat to the nation that they are allowed to violate rules.
“We don’t believe there is the need for any further evaluation, and we are making ourselves available for the impeachment hearing because we believe that mental health issues will become critical as pressures from the impeachment hearings mount,” Dr. Lee told the
Washington Examiner.
“In other words, the more successful the impeachment proceedings become, the more dangerous the psychological factors of the president will become.”
Obviously, the thing to do is to increase the psychological pressure on a person you declare to be unstable.
Dr. Lee’s “medical assessment” of the president’s “mental capacity to fulfill the duties of his office” includes the examination of tweets, public appearances and the 448-page Mueller report. “There is very little that a personal examination will add,” Lee said.
She denies that she is actually making a diagnosis. Indeed, “unfitness for office” is an opinion, a conclusion that is not in the DSM, the Diagnostic and Statistical Manual of currently defined psychiatric diagnoses.
Regardless of one’s opinion about President Trump, this self-appointed “Independent Expert Panel for Presidential Fitness” should concern all Americans. Where does a group of academic experts get the ability or the authority to determine whether the President is “capable of keeping the country safe”?
The U.S. Constitution provides several methods of “regime change,” which is what Congressional Democrats, the mainstream news media and this panel seem determined to achieve. The first is elections. In 2016, Americans voted for a change from the policies of Obama and Clinton and the imbedded bureaucracy. Ever since then, the losers have been seeking to nullify this result. Attacks on the president by the press have been unrelenting.
Unlike Abraham Lincoln or Woodrow Wilson, this president has not imprisoned any journalists or shut down any newspapers. But he does make sarcastic remarks – and his opponents would like to deny him the forum of social media.
Second is the 25th Amendment, which provides for the removal of a President for incapacity. This might have removed Woodrow Wilson after a devastating stroke had it been in existence at the time. It requires action by the Vice President and a majority of executive officers or a body appointed by Congress – not a few activist academics. This has so far been a non-starter.
Finally, there is impeachment, for “high crimes and misdemeanors.”
In American jurisprudence, proceedings are supposed to be triggered by a crime – not by the Soviet KGB method of “show me the man, and I will name his crime.” Or worse, “KGB Plus” – show me the man, and I will invent his crime.
In a world where there are so many ever-changing rules that everyone might be inadvertently committing “three felonies a day,” anyone could be prosecuted. But one is at least supposed to have certain rights: confronting the accuser, assistance of counsel, access to all the evidence, the right to call and cross-examine witnesses. And knowing exactly what the charges are.
Why should psychiatrists be intruding themselves into this legal process? Are there "thought crimes" that they have a special ability to discern?
Ordinary Americans should be very concerned. If this can happen to the president, it can happen to them. And it does.
One alarming example is the “fitness for duty” evaluations to which physicians may be subjected by people who for some reason want to destroy them. There are virtually no due-process rights. The examiner has the status of a physician, but no obligation to act in the “patient’s” (target’s) best interest. Some psychiatrists may presume to have god-like power to judge a person’s emotions, intentions, and capacity – asserted in the name of safety or “security.” “Red flag” laws are another example.
President Trump may be right in saying: “They’re not coming for me. They are coming for you. I’m just in the way.”
Bandy Lee and associates are showing us a method to remove undesirables if legal process fails.

Thanks for correcting me, Wally C, or whatever your name is. Conscription is mandatory in Switzerland, and while in the service those serving may keep their gun in their home. This obviously does not mean that everyone has a gun in their home. The last time they tried to do away with conscription, by the way, the vote was 73% against eliminating it. Perhaps we should bring back conscription and throw all 18 year olds in the military for a year. That should melt the snowflakes. And before you ask me if I served when I was 18, the answer is no, I didn't. That bothered me later and I served here in Georgia from age 59 to 65, which some may remember.

Hate to say this Jim, but you are wrong again. Every citizen in Switzerland is not " required " to own a gun, they have a very liberal gun control policy, but it is not a requirement to own a gun

As a wannabe sacred centrist, I would want not the federal government to require each citizen to own a firearm as in Switzerland. If a person doesn't like guns and doesn't want any, that's perfectly fine with me. But, don't push for policies and laws to keep me from getting mine. I've also noticed other things about anti-gun people. They are really unfamiliar with particular firearms and accessories. And they don't really understand the people who own them and why.... Editor, I also keep my posts fairly short compared to others. But I sure do try to make up for it with more of them.

Matthew, of course the point was the approach to guns which you and I are on the same page. Travels this year for me have been focusing on the S's: Singapore, Seaman and Switzerland. (Another weak attempt at humor for those of you counting responses). ••••Editor's note: There are many great people with Seaman addresses.

I don't know if I'm being a sacred centrist or not, but I think the Democrats are doing a good job in the House when they demonstrate to the voters they are totally focused on impeachment. Also, all those Democrat candidates in the Presidential primary are some of the best the party has to offer. (I'm trying to get in the 90% range in the comments section to make another commentator's statement true... I like a challenge) ••••Editor's note: Matthew, in a quick glance at the last 1,000 comments, you are around 12 percent. Still in our top 5, but not close to 90 percent. Good luck. The ones that are funny are the multiple anonymous folks with the same IP address. The power of their convictions is beyond weak.

Did anyone read my comments on this article? At least two of them were feeble attempts at humor. Matthew, we are about to go to Switzerland on vacation. Switzerland has the same population as Haiti. Haiti does not allow private ownership of guns and has the highest murder rate in the world. Switzerland requires everyone to have a gun and has the lowest murder rate in the world. For the 10,000,000,000,000th time, guns are not the problem.

John T., I've tried to point out to some who disagree with President Trump about how good he is doing, and how great the economy is and so forth. But they are unable to acknowledge or give any credit to Trump. It's removal from office or bust. Every little irregularity Trump does that is against past practices of the establishment DC politicians is an impeachable offense. And another hot topic is when an evil individual goes on a rampage. Within minutes, high profile liberals are railing for draconian gun control. Never mind the instability in the perpatrator's thought process. Or an under-supervised disturbed youth that got out of control one day and causes tragedies for dozens of families. We are all told our access and ownership of legally owned weapons, protected by the Constitutions of the Country and of the various States, is the problem. I was at a gun show today. Thousands of firearms in one big building with a few thousand people. No one was harmed. No weapon went off. How is that possible? There were single shot, double-action, lever-action, pump, semi-automatic, and fully automatic firearms there. Not a soul was lost to violence. Could it be there was not a violent, evil person there? Or if there was, he was strongly deterred by the presence of that much hardware and law abiding gun owners. I bought a 30 round magazine today. Am I a threat to society now with a hard plastic box and spring? Someone said Jim and I have 90% of the comments. The only thing I think that is 90% with me on this forum is the percentage of my questions that go unanswered. So much for a dialogue when my perfect questions are too logical for some to give a rational response.

Jennings, only 6 of the 13 comments in this particular thread are from Jim and Matt, so that's not even 50%. Calling those they disagree with crazy, shallow, greedy, worthless lock step socialist liberals and diagnoseing them with Trump Derangement Syndrome is not bullying, it's just their way of trying to initiate a meaningful dialogue. I suspect the great and unmatched wisdom of these stable geniuses is just so intimidating that many are afraid to disagree with them. Either that or there is no point in replying to either since all their comments are perfect.

I strongly disagree Jennings. There are certain respondents in this forum whom I have stopped reading and responding to, simply because they don't want to have a dialogue and are so lock step in their shallow, greedy and condemning thinking that it is not worthwhile. I have changed my tone in my own columns to make sure I am more conciliatory and explain matters to a greater depth. All to no avail. The dialogue of the Left is a steady drumbeat towards socialism or worse, no one else is to be listened to, no one else matters. I fear they will ultimately "win" and destroy the United States. The Venezuela thinking has already gotten a strong toe-hold in California and will continue to march across the country. Less than a month after shop owners in San Francisco have been told they have to clean up the human feces in front of their stores, this same idea has taken root in Denver. Total depravity and decadence.
